Introduction

These are the terms and conditions for working with Mondello Marketing, operated by Ryan Barrett as a sole trader based in Uddingston, Scotland.

By hiring me for any service, you're agreeing to these terms. I've written them in plain English because legal jargon helps nobody. If anything's unclear, just ask.

Services Provided

I offer the following services:

• Website design and development
• Local SEO (search engine optimization)
• Drone photography and videography
• Social media content creation and management

The specific details of what I'll deliver will be agreed in writing before work starts (usually via email or a proposal document).

Payment Terms

Accepted Payment Methods

I accept payment via:

• Bank transfer
• PayPal
• Cash

Website Projects

For website design and development projects:

• 20% deposit required before work starts
• Remaining 80% due on completion before the site goes live

Google Business Profile Optimization

Payment required upfront before work begins.

Ongoing Monthly Services (SEO, Social Media)

For monthly retainer services like local SEO and social media management:

• Payment due on the 1st of each month
• Payment covers the current month's work
• Minimum commitment: 1 month

Drone Photography & Video

Payment due on arrival at the job site before filming begins.

Late Payment

If payment is overdue, I reserve the right to pause or stop work until payment is received. For ongoing services, late payment may result in service suspension.

Cancellation & Refunds

One-Off Projects (Websites, Drone Work)

• Deposits are non-refundable
• If you cancel after work has started, you'll be charged for work completed up to that point
• No refunds are offered once a project is completed and delivered

Ongoing Monthly Services (SEO, Social Media)

You can cancel at any time by giving 30 days written notice (email is fine).

• You'll be charged for the full 30-day notice period
• Work will continue during the notice period
• No refunds for months already paid
• After cancellation, I'll hand over all accounts and access to you

Project Timelines

I'll give you an estimated completion date for your project. However, timelines may change due to:

• Additional work requested by you
• Delays in receiving content, feedback, or approvals from you
• Weather conditions (for drone work)
• Technical issues or circumstances beyond my control

I'll always keep you updated if timelines change and work with you to find a solution.

Ownership & Intellectual Property

What You Own

Once you've paid in full, you own:

• The final website and all its content
• All drone footage and photographs (both raw files and edited versions)
• Any logos or graphics I create specifically for you
• All social media content I create for your business

My Portfolio Rights

I may use your project in my portfolio and marketing materials, including:

• Screenshots of your website
• Drone photos and videos I've created for you
• Mentioning your business name and what I did for you

I'll always ask your permission first. You can say no, or ask me to remove your work from my portfolio at any time. See my Privacy Policy for more details.

Third-Party Content

You're responsible for ensuring you have the rights to any content you provide me (photos, text, logos, etc.). I'm not liable for any copyright issues with content you supply.

No Guarantees on Results

I'll always do my best work, but I cannot guarantee specific results such as:

• First page Google rankings
• Specific increases in website traffic or sales
• Social media follower growth or engagement rates

SEO and social media results depend on many factors outside my control (competition, algorithm changes, market conditions, etc.). I'll work hard to improve your online presence, but no one can guarantee rankings or viral success.

Website Support & Maintenance

After your website is delivered:

• If something breaks due to my work, I'll fix it free of charge
• Basic support and bug fixes are included for 30 days after launch
• After 30 days, ongoing support and updates can be arranged separately

You're responsible for keeping regular backups of your website after I hand it over.

Limitation of Liability

My total liability for any claim related to my services is limited to the amount you paid me for that specific project or service.

I'm not liable for any indirect losses such as lost profits, lost business, or lost opportunities. This applies except where the law doesn't allow such limitations (e.g., death or personal injury caused by my negligence).

Your Responsibilities

To help me deliver great work, you agree to:

• Provide content, images, and information I need in a timely manner
• Give clear feedback and approvals when requested
• Provide access to necessary accounts (website hosting, Google Business Profile, social media, etc.)
• Make payment on time as agreed

If you don't provide what I need, it may delay the project or impact the quality of work. I'll always communicate with you if this becomes an issue.

Revisions & Changes

The number of revisions included depends on the service and will be agreed upfront. Typical examples:

• Website projects: Usually 2-3 rounds of revisions
• Drone footage: 1 round of edits
• Ongoing services: Ongoing adjustments as part of monthly work

Additional charges apply if:

• You request work beyond the original quote or scope
• Major changes are requested after approval
• The project takes significantly longer due to excessive revision requests

I'll always discuss and agree any additional costs with you before proceeding.

Third-Party Services & Tools

I use the following third-party services to deliver your work:

• Vercel: Website hosting
• GitHub: Website code storage and version control
• Google Analytics (GA4): Website analytics
• Gmail: Email communication

Account ownership: Where possible, accounts will be set up in your name or we'll share access. For ongoing services, I may maintain primary access during our working relationship and transfer full ownership if you cancel.

Costs: Most of these services are free or very low cost. Any third-party costs (like domain names or premium hosting) will be discussed with you upfront. Generally, you're responsible for paying for your own accounts and tools.

Drone Photography & Video - Specific Terms

Legal Compliance

I hold a valid CAA (Civil Aviation Authority) Operator ID and have appropriate commercial drone insurance. All flights comply with UK drone regulations and the CAA Drone Code.

Weather & Conditions

Drone filming is weather-dependent. If conditions are unsafe to fly (high winds, rain, poor visibility), I may need to:

• Reschedule the shoot
• Offer a refund

The choice is yours. I'll never fly in unsafe conditions.

Flight Restrictions

Some locations cannot be flown due to legal restrictions (near airports, military sites, built-up areas without permissions, etc.). I'll check restrictions before accepting a booking, but if unforeseen restrictions prevent filming, you can choose to reschedule or receive a refund.

Site Access & Permissions

You're responsible for ensuring I have permission to access the site and fly at the location. This includes landowner permissions, safety considerations, and notifying relevant parties.

Disputes & Problems

If something goes wrong or you're unhappy with my work:

1. Talk to me first - most issues can be sorted out with a friendly conversation
2. I'll do my best to fix any problems or find a solution that works for both of us
3. If we can't resolve it between us, we can try mediation

These terms are governed by Scottish law, and any legal disputes will be handled in Scottish courts.

Changes to These Terms

I may update these terms occasionally. The "Last updated" date at the top shows when they were last changed. If I make significant changes, I'll let existing clients know by email. For new projects after the update, the new terms will apply.
